Written by: Peterson & Myers, P.A.

Duke Energy is planning a new 69 KV overhead electric transmission power line in Davenport from Minute Maid Ramp Road to Florida Development Road.

Utility companies are included as condemning authorities under the Florida eminent domain statutes. It is important to remember that condemning authorities are required to pay not only a reasonable price for the land taken, but also for your reasonable attorney and expert fees and costs.

It is also important to remember that you have no obligation to accept the condemning authority’s first offer, and legal representation is a vital asset in the negotiation process. Please feel free to contact lawyers Deborah A. Ruster or Jillian T. Spangler with any eminent domain questions you may have.

Eminent domain proceedings can have surprising reasons for additional compensation, so make sure to read our blog “Not Just Dirt: Damages You Can Be Compensated For In Eminent Domain Cases” for a brief primer on different damages available.
